General Indemnity

You agree to indemnify, defend, and hold APCRA and all of its agents, directors, employees, information providers, licensors and licensees (collectively, “Indemnified Parties”), harmless from and against any and all liability and costs (including, without limitation, lawyers’ fees and costs), incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms and Conditions of Use or the representations, warranties, and covenants or your use of this Site. You will cooperate as fully as reasonably required in APCRA’s defence of any claim. APCRA reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of APCRA.

Limitation on Use and Indemnity
9. This Site may have an area which allows you to upload materials. You also agree to waive any right which you have or may have against us arising out of any information or contents posted or transmitted by any user of this Site whether such information or content is regarded as objectionable or inappropriate or in violation of any of your rights under Hong Kong or foreign law.

APCRA will fully cooperate with any law enforcement authorities or court order requesting or directing APCRA to disclose the identity of anyone posting such materials.

Privacy and Use of Personal Information

APCRA operates internationally, and some of our computer systems are currently based in Hong Kong Special Administration Region (“HKSAR”), your personal data will, if required, be processed by APCRA in HKSAR where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. By using this Site, you consent to the collection and / or processing in HKSAR of your personally identifiable information, which includes the use of cookies. By providing any personal information to the APCRA websites, all users, including without limitation users in the member states of the European Union, fully understand and unambiguously consent to the collection and processing of such information in HKSAR.
